howdy all, i am the state coordinator here in Texas and i have some good solid information for all Texans interested in this movement. i have enlisted some very solid help from an activist here and we are positively moving to make our movement a reality in Texas. There are other people offering help and they also are very positive activists who have helped the cause of freedom in other states. Now we need to nail down for sure a date to rally in Austin. i am thinking saturday April 17th and am trying to gain the support of allies in the legislature. We are moving forward and we will have a rally in Austin. Stay tuned and keep in touch.

As I understand it, long gun open carry is not prohibited and is therefore entirely legal, even in Austin. Handguns, of course, are another story. Are there any plans for the march in Austin involve an empty-holster protest, for those who either don't own long guns or don't bring them?

However, your statement that people with concealed license's cant bring their firearms........well now that's suspect at the very least. Isn't the right to keep and bear arms part of the constitution...... yet this is suppose to be a "PRO-CONSTITUTION RALLY". Sounds like a contradiction to me...... I think the Obama folks are looking for a few good people just like you.

Mark, you're missing the point of the marches, which is to exercise our rights in a legal, non-violent manner while pressing for governments at all levels to more fully honor those rights. Bear in mind that open carry of a handgun, even by a CCW holder, is a crime here in Texas. Given that crimes involving deadly weapons are, AFAIK, automatically felonies, a conviction on such a charge could cost the license-holder both his license and the ability to acquire more guns in the future. This is why I asked Alan about empty holster protests. I believe in civil disobedience, but I'm not going to give up my ability to protect myself just to make a point.
If you favor open carry (as I do) or campus carry (as I do), the best way to push for it right now is to arrange things like empty holster protests, rather than to randomly draw a six gun in the middle of a college quad or shopping mall.

Because it is the right of all people to keep and bear arms, we fully support the peaceful carrying of firearms where allowed by law. the Austin rally will happen saturday april 17. we will meet in the large parking lot at 2nd street and congress... we will march up congress to the capitol starting at noon. So please plan on meeting no later than 10 a.m. As for the bearing of arms... i cannot stop nor will i tell anyone NOT to. I do NOT advocate carrying sidearms openly as you will probably be arrested. License holders of course can carry concealed anywhere it is legal to do so. As far as long arms is concerned or any on capitol GROUNDS i do not know the legality there but i will have an answer within days for all to read here and i will email my list with the answer. I know bearing long arms in Texas is not illegal... i hope to have Wil Radford speak. He i believe helped get the first shall issue law passed in Florida as a member of the North Central Florida sportsmens club. I of course will speak and i hope to get a few others but have no info yet on that.

As a peace officer in Texas I am well aware of what Texas laws are regarding the carrying of firearms. I do not recall making any statement in my post about "openly carrying firearms" during the rally and did not encourage anyone to do so. I referred to an e-mail sent by Alan which was contradictory in nature and in which he encouraged CHL holders attending not to carry firearms. In other words he was and is attempting to prevent those lawfully carrying a firearm via a concealed carry license from attending a rally. For the record you will find my original comment below which was posted in reference to the Texas rally, not the DC rally.
You can’t have it both ways here. You either support the rally and what it stands for or you do not. Andrew… I am not missing any point. I support a peaceful rally and would have it no other way. I do not advocate violence or the violation of any law, at any time as this would be detrimental to our cause.
However, I do not think that folks legally carrying a concealed weapon should be asked not to come or be prohibited from attending the rally simply because they choose to exercise there right to “legally” carry a concealed firearm.

Mr. Doan, to set the record staight, i have reconciled the email i sent out and you got one of those,i posted it here also for all to read... i was wrong to say ANYTHING about bearing arms at all. i was thinking of the recent shooting on the capitol steps and was worried about MY liability thank you sir! As you requested:
Displaying of a firearm in public may violate the following statute and as such is an arrestable offense.
Sec. 42.01. DISORDERLY CONDUCT. (a) A person commits an offense if he intentionally or knowingly:
(8) displays a firearm or other deadly weapon in a public place in a manner calculated to alarm;
(d) An offense under this section is a Class C misdemeanor unless committed under Subsection (a)(7) or (a)(8), in which event it is a Class B misdemeanor.
One should note that depending upon the situation, location, etc... other statutes may apply such as chapter 46 of the penal code which deals with weapons and where they are prohibited as well as other violations. In addition the City of Austin may have city ordinances in place regarding the display or use of weapons within the city. Last but not least, given the right circumstances, situation, location, etc.... federal laws may also be in play. I am referring to gun free school zones, etc. I include this not knowing the route and specfic location(s) of the march.

This is the law concerning brandishing, right? This may be a question for a lawyer, but do you know of case law that clearly establishes the difference between harmless display and 'a manner calculated to alarm'? It would seem to me, as a private citizen with no legal training, that the primary difference between display and disorderly conduct is the intent of the person holding the weapon, with some allowance made for visible demeanor. However, some people find the mere presence of weapons alarming, so display vs brandishing might also be in the eye of the beholder.
This is all rather moot for me, as I am not an CHL holder and don't yet own any long guns. I am just curious about the legalities involved.

Yes I believe it is the statute you are referring to. No I am not aware of any specific case law.
Regarding this statute one would have to prove “intent” however if one person is “alarmed” for enforcement purposes intent is virtually established. Understand that I am not talking about prosecution or establishment of guilt beyond a reasonable doubt. I am just saying that one might very well end up arrested and charged regardless of the later outcome.
It would be wise in my opinion not to walk around with firearms displayed. Follow the law. Carry concealed if, when and in a manner allowed by law. Otherwise dont bring a firearm. Viking Princess 45acp said it well in her post.

I will confirm the situation with the parking lot within the next few days and post it here.
There are various State parking lots, that are usually free (no parking fees), located on Trinity St. (one-way traveling north) between 12th St. and 17th St.'s. Some of these lots you can access from San Jacinto Blvd (one-way traveling south) between 17th and 12th St.'s as well.
Granted, these parking lots are closer to the State Capital (Congress and 11th St.).
I am guessing the march will end at the Capital with possibly some speakers talking about RKBA. However, these parking lots are further from where we will be meeting at Congress Ave. and 2nd St., so that we can march in mass to the Capital.
Please take this into account for those of you that may have limited mobility.
Regarding the parking lot at Congress Ave. and 2nd St., from what I can tell when driving by the parking lot, it is basically a typical pay to park parking lot. Parking lots of this type range from $5 to $7 for parking.
Again, I will recon and report within the next few days.

Here is the situation, cost wise, on parking at the parking lot at Congress Ave. and 2nd St. During the week the parking fee is $5. There is another parking lot adjacent to this one that is located at Brazos St. and 3rd St. This parking lot is $7 during the week. Both lots may be higher priced on the weekend.
Nonetheless, typical downtown parking spots along the streets are free.

howdy all, this is your state coordinator alan! it would be nice if i could get a head count of how many might show up... i plan on starting in the lot at 2nd and congress and walking the sidewalk to the capitol and then back to the parking lot... there are flyers and banners you can down load to print out... the banners obviously need a heavy vinyl reinforced material to print onto but the flyers are free and you could enlarge them... if you create your own signs, keep them real simple so they are easy to read and keep to our point. the 2nd guarantees all the rest!!! March 21st, 2010 is the SECOND darkest day in American history, the first of course is the day b.o. was elected to destroy our country... howdy chaplain, the 2a rally in Austin on saturday April 17th will meet in the parking lot at 2nd street and congress. We will meet at 10am and then walk to the capitol building about 11:30 and gather there for an hour or so. i will speak, Wil Radford will speak and i have a gentleman who is a retired secret service agent who may speak also... when we finish we will walk back to the parking lot and go from there. i believe there may be some extra activities after that, i am not sure of details just yet.

As you requested:
Displaying of a firearm in public may violate the following statute and as such is an arrestable offense.
Sec. 42.01. DISORDERLY CONDUCT. (a) A person commits an offense if he intentionally or knowingly:
(8) displays a firearm or other deadly weapon in a public place in a manner calculated to alarm;
(d) An offense under this section is a Class C misdemeanor unless committed under Subsection (a)(7) or (a)(8), in which event it is a Class B misdemeanor.
One should note that depending upon the situation, location, etc... other statutes may apply such as chapter 46 of the penal code which deals with weapons and where they are prohibited as well as other violations. In addition the City of Austin may have city ordinances in place regarding the display or use of weapons within the city. Last but not least, given the right circumstances, situation, location, etc.... federal laws may also be in play. I am referring to gun free school zones, etc. I include this not knowing the route and specfic location(s) of the march.

This is the law concerning brandishing, right? This may be a question for a lawyer, but do you know of case law that clearly establishes the difference between harmless display and 'a manner calculated to alarm'? It would seem to me, as a private citizen with no legal training, that the primary difference between display and disorderly conduct is the intent of the person holding the weapon, with some allowance made for visible demeanor. However, some people find the mere presence of weapons alarming, so display vs brandishing might also be in the eye of the beholder.
This is all rather moot for me, as I am not an CHL holder and don't yet own any long guns. I am just curious about the legalities involved.

Regarding this statute one would have to prove “intent” however if one person is “alarmed” for enforcement purposes intent is virtually established. Understand that I am not talking about prosecution or establishment of guilt beyond a reasonable doubt. I am just saying that one might very well end up arrested and charged regardless of the later outcome.
It would be wise in my opinion not to walk around with firearms displayed. Follow the law. Carry concealed if, when and in a manner allowed by law. Otherwise dont bring a firearm. Viking Princess 45acp said it well in her post.

There are various State parking lots, that are usually free (no parking fees), located on Trinity St. (one-way traveling north) between 12th St. and 17th St.'s. Some of these lots you can access from San Jacinto Blvd (one-way traveling south) between 17th and 12th St.'s as well.
Granted, these parking lots are closer to the State Capital (Congress and 11th St.).
I am guessing the march will end at the Capital with possibly some speakers talking about RKBA. However, these parking lots are further from where we will be meeting at Congress Ave. and 2nd St., so that we can march in mass to the Capital.
Please take this into account for those of you that may have limited mobility.
Regarding the parking lot at Congress Ave. and 2nd St., from what I can tell when driving by the parking lot, it is basically a typical pay to park parking lot. Parking lots of this type range from $5 to $7 for parking.
Again, I will recon and report within the next few days.

Here is the situation, cost wise, on parking at the parking lot at Congress Ave. and 2nd St. During the week the parking fee is $5. There is another parking lot adjacent to this one that is located at Brazos St. and 3rd St. This parking lot is $7 during the week. Both lots may be higher priced on the weekend.
Nonetheless, typical downtown parking spots along the streets are free.

howdy all, this is your state coordinator alan! it would be nice if i could get a head count of how many might show up... i plan on starting in the lot at 2nd and congress and walking the sidewalk to the capitol and then back to the parking lot... there are flyers and banners you can down load to print out... the banners obviously need a heavy vinyl reinforced material to print onto but the flyers are free and you could enlarge them... if you create your own signs, keep them real simple so they are easy to read and keep to our point. the 2nd guarantees all the rest!!! March 21st, 2010 is the SECOND darkest day in American history, the first of course is the day b.o. was elected to destroy our country... howdy chaplain, the 2a rally in Austin on saturday April 17th will meet in the parking lot at 2nd street and congress. We will meet at 10am and then walk to the capitol building about 11:30 and gather there for an hour or so. i will speak, Wil Radford will speak and i have a gentleman who is a retired secret service agent who may speak also... when we finish we will walk back to the parking lot and go from there. i believe there may be some extra activities after that, i am not sure of details just yet.
